WATER turns MIRAGE here!!!

This region is extremely arid and drought prone most of the times,  shortage of water is a frequent scenario in towns and cities of this region. Situated in the northern this is the Banaskatha district of Gujarat. 214 families of Fulvadee community have been staying in the Kakar village of Kakrej block for many years. To ease out the water issue of such large concentration a bore-well had been installed a couple of years ago. The bore-well functioned for sometime and than developed a snag and stopped. After that  a tank was constructed but water has never reached this tank  yet. When the construction of the tank  was underway it was said that waters of Narmada will reach this tank but that has also has never happened. Gram panchayat has installed taps to supply water but the pressure in taps is so low it fills only  3-4 buckets. Under such  dire conditions people have to walk 2-3 kilo-meters every day to get water from nearby private bore-wells on farms. They also have to depend on the mood and fancy of the farmers.                          

The scarcity of water is having a  direct impact on the community's capacity to lead a settled life. The scarcity is forcing these families to keep wandering. 150 children who should be going to school are wandering with their parents just because water has not reached their settlement as yet. 

આવું ખોટું પંચનામું કરનાર તલાટી સામે કંઈ કાર્યવાહી થશે?

બનાસકાંઠા જીલ્લાના કાંકરેજતાલુકાના કાકરગામમાં ફૂલવાદીના ૨૧૪ પરિવારો રહે છે. આ વસાહતમાં પીવાના પાણીની મુશ્કેલી છે, આ અંગે મુખ્યમંત્રી શ્રીને, માનવ અધિકાર પંચમાં અને જીલ્લા કલેકટર શ્રીને... રજૂઆત કરી હતી. આ રજૂઆતનો જવાબ આવ્યો જેમાં જણાવવામાં આવ્યું કે, ‘આ વસાહતમાં સબમર્શીબલ પંપ સેટની યાંત્રિક તકલીફના કારણે પાણી – પુરવઠો બંધ હતો જે રીપેર થઇ જતાં પૂરતા પ્રમાણમાં જરૂરિયાત મુજબનું પાણી પૂરું પાડવામાં આવે છે. અને પીવાના તેમજ વપરાશના પાણીની કોઈ તકલીફ નથી તેમજ પાણીની સમસ્યાના કારણે સ્થળાંતરની કોઈ સમસ્યા નથી.’ આવું પંચનામું કરી તલાટી શ્રીએ નાયબ કલેકટર ડીસાને આપ્યું અને નાયબ કલેકટરે અમને જવાબ આપ્યો અને અમારી રજૂઆતનું સમાધાન થઇ ગયાનું જણાવ્યું.
હકીકતમાં- આ પરિવારોને હજુ પાણી મળતું જ નથી. કોઈ પંપ રીપેર થયો નથી. વાદી પરિવારોનો જવાબ લેવા વસાહતમાં કોઈ ગયું નથી તો પંચનામું કેવી રીતે થયું તે પ્રશ્ન છે! લોકો હેરાન થઇ રહ્યા છે ત્યારે એમની સમસ્યાનું સમાધાન કરવાને બદલે એમને પાણી માટે વલખાં મારતા કરવાનો મતલબ શું છે? આવા પંચ નામાનો અર્થ શું છે? આવું ખોટું પંચનામું કરનાર તલાટી સામે કંઈ કાર્યવાહી થશે. અમે રજૂઆત કરી છે. હજુ શું જુઠ્ઠાણું કહેવામાં આવશે?
હાલમાં પાણી માટે રઝળતા બહેનોના ફોટો નીચે છે. અને અગાઉ ફેસબુક પર આ બાબતે લખ્યું હતું તે પણ નીચે સામેલ છે.

(આમ તો ટાંકી બનાવી ત્યારે એમાં નર્મદાનું પાણી આપવાની વાત કરેલી. પણ પાણી આવ્યું જ નહિ એટલે વાદી પરિવારો કહે છે કે, નર્મદાનું પાણી ના આપો તો કઇ નહિ ગ્રામ પંચાયતના બોરનું પાણી તો આપો.) ગ્રામ પંચાયતે પાણીની વ્યવસ્થા માટે વસાહતમાં ચાર નળ નાખ્યા છે જેમાં પાણીનો પ્રવાહ એટલો આછો છે કે, પંચાયત જેટલો સમય પાણી આપે એમાં માંડ પાંચ – છ વાસણ ભરાય. આ વસાહતના લોકો પાણી માટે ૨ થી લઇ ૩ કી.મી. સીમમાં આવેલા ખેડૂતોના બોરવેલ પર રઝળે છે. એમાંય દર વખતે ખેડૂત પાણી ભરવા દે તેવું ના પણ બને? પાણીની એટલી મુશ્કેલી છે કે, વસાહતના લોકો શાળાએ જઈ શકે એ ઉંમરનાં ૧૫૦ ઉપરાંત બાળકો સાથે વિચરણ કરે છે. જેના કારણે બાળકોનું ભણવાનું બગડે છે. સ્થાઈ રહી શકાય એવી તમામ સુવિધા છે પણ પાણી નથી એટલે રઝળપાટ છે. )

કાકરની વાદી વસાહતમાં પાણી શરુ થઇ ગયું... (18/12/2013)
બનાસકાંઠા જીલ્લાના કાંકરેજતાલુકાના કાકરગામમાં ફૂલવાદીના ૨૧૪ પરિવારોને પડતી પાણીની મુશ્કેલી અંગે અહી લખ્યું હતું. તલાટીએ ખોટો જવાબ આપી વસાહતમાં પાણી આવે છે એવો જવાબ કલેકટરશ્રીને આપ્યો હતો. આપણે આ જવાબ ખોટો છે તે અંગે કલેકટર અને માનવ અધિકાર પંચમાં લખી એમનું ધ્યાન દોર્યું હતું.
તે પછી પ્રાંત કલેકટર વસાહતમાં રૂબરૂ તપાસમાં ગયા. પંચાયતે વસાહતમાં ૬ નળ નાખ્યા અનેપુરા પ્રવાહ સાથે પાણી આપવાનું શરુ કર્યું છે.
કાકરના અને એ સિવાયના ઘણા કિસ્સામાં જોયું છે કે, અધિકારી પોતે તકેદારી રાખે તો વંચિતોના કામમાં કોઈ મુશ્કેલી નથી આવતી.
કાકરના સરપંચ પહેલા વસાહતના લોકોને કહેતા કે, "તમારે લ્યા પાણી શું કરવું છે? " એની જગ્યાએ અધિકારીની આખી ટીમ આ અંગે તપાસમાં ગઈ પછી સરપંચ કે છે કે, "પાણી ના આવે તો મને ફોન કરવાનો!"

214 Fulvadee families of Kakar village in Kankrej block of Banaskatha district had been facing tremendous water scarcity. VSSM had written about this issue earlier. The Revenue Officer had lied in the query raised by the Collector saying that water has reached the Fulvadee settlement. VSSM brought this lies to the notice of concerned officials and Human Rights Commission. Following which the Deputy Collector paid a visit to the settlement to inspect the matter. There was no water reaching the settlement. Following this visit water with full pressure has began flowing through the 6 community taps in the settlement. 

The Sarpanch of Kakar who earlier said why do these families need water has now asked them to call him if water does not reach the settlement!!!


In not just Kakar but on many other instances it is the official’s will that makes all the difference. We just hope and wish to have  more and more such officials who are willing to make that difference.

The Nomadic and De-notified tribes (NT-DNT) of our country live  on the brink. Never accepted by the village communities, no homes to stay, barely able to hold on to their traditional occupations, their children denied access to schools,  churning amidst a political and bureaucratic network that is to a large extent ignorant of their struggles of survival,  these communities are shunned by one and all. 

The  NT-DNTs do not have any proofs of existence. No certificate, no document what so ever.  VSSM,  since last five years has been actively trying to give an identity to these communities and has been the reason behind some of the proactive policy level changes affecting these communities.  Certain breakthrough amendments in the list of prerequisites for issuance of a Voters ID card have been possible because of VSSM's advocacy. 

Block Level Officer (BLO) visiting the area specified by the applicant to ascertain his/her place of residence where in if the BLO finds the the applicant present at the place he has mentioned in the application for the officer had to consider it as his/her house even if it is a tarpaulin on a footpath/roadside.

With regards to the age proof the applicant just has to state his/her age on duly signed paper whereas for the applicants between the ages of 18 to 21 years, the age mentioned by the parents that is to be taken into consideration by the authorities.

Both this regulations were passed following VSSM's continuous dialogue with the Office of the  Election Commissioner so as to ease out the process of acquiring a Voter's ID card in absence of  residence, address and age proofs. This has enabled the nomadic and de-notified communities to acquire one of the basic document to this country. Ironically in spite of such regulations challenges are faced by the communities and VSSM team in getting Voter's ID card when the local authorities at many places refused to respect the modified regulations. 

VSSM brought this to the notice of present Chief Election Commissioner (CEC) Ms. Anita Karwal, who in response launched a campaign to allot Voter's ID cards to as many members of nomadic and de-notifed communities as possible. VSSM was allotted the responsibility  of preparing and sending a list of potential applicants to the office of Chief Election Commissioner. Many individuals have ben able to receive Voter's ID card based on the list presented. There were hitches and glitches in the process yet a lot has been accomplished in this regard. We are not exaggerating  when we claim that Gujarat is the first state wherein a voluntary organisation and bureaucracy  have partnered for such a cause to achieve an overwhelming outcome.

ગુજરાતના મુખ્ય નિર્વાચન અધિકારી શ્રી અનિતાબેન કરવાલની મદદથી ગુજરાતમાં વસતા વિચરતી – વિમુક્ત જાતિના અને મતદારકાર્ડ વિહોણા લોકોને કાર્ડ મળે તે માટેની ઝુંબેશ આરંભાઈ. મૂળ તો મતદાર કાર્ડ મેળવવા માટે અરજી ફોર્મની સાથે જે તે વ્યક્તિએ રહેઠાણના પુરાવા, ઉંમરના આધાર વગેરે જોડવા પડે. વિચરતી જાતિના લોકો સદીઓથી એક ગામ થી બીજે  પોતાના પરમ્પરાગત વ્યવસાયના આધારે નભતા હોવાના કારણે વિચરણ કરતા રહ્યા. જેના કારણે તેઓ સ્થાઈ થયા નહિ. અલબત કોઈ ગામમાં સ્થાઈ થયા હોય તો પણ એ ગામના લોકો એમને પોતાના માને નહિ એટલે એમની પાસે પોતાની ઓળખના એવા કોઈ પુરાવા હોય નહિ.

vssm છેલ્લા પાંચ વર્ષથી આ પરિવારોને પોતાની ઓળખના આધારો અપાવવાની કોશિશ કરે છે. આ સમુદાયના અધિકારો સંદર્ભે ઘણા નીતિગત ફેરફારો પણ vssm ના કારણે થયા છે.

મતદાર કાર્ડ માટે વિચરતી જાતિ જેવા ઘર વિહોણા વ્યક્તિઓના કિસ્સામાં સ્થાનિક અધિકારી બી.એલ.ઓ. જાતે જઈ તપાસ કરે અને આ પરિવારો ત્યાં જ રહેતા હોય તો એને આધાર ગણી કાર્ડ આપવાની પ્રક્રિયા કરી શકાય તેવા ફેરફાર થયેલા છે. ઉમરની બાબતમાં પણ ૧૮ થી ૨૧ વર્ષના વ્યક્તિઓના કિસ્સામાં જ ઉંમરનું પ્રમાણપત્ર જોડવાનું બાકી જે તે અરજદાર પોતાની ઉમર સંદર્ભનું નિવેદન એક કાગળ પર લખી આપે તે માન્ય રાખવાનું. ૧૮ થી ૨૧ વર્ષના વ્યક્તિઓના કિસ્સામાં માં-બાપ પોતે લખી આપે કે મારા દીકરા કે દીકરીની ઉમર આટલી છે તો તે પણ માન્ય રાખવાની જોગવાઈ થઇ. આ બધી જોગવાઈ થયા પછી મુશ્કેલી તેના અમલની હતી. એમાં ઘણી તકલીફ પડતી હતી.

 

આદરણીય અનિતાબેનના ધ્યાનમાં આ બાબતો લાવતા એમના દ્વારા વિચરતી અને વિમુક્ત જાતિના લોકોને મતદારકાર્ડ મળે તે માટેની ઝુંબેશ આરંભાઈ. vssm ના કાર્યકરોએ ૧૦,૦૦૦ ઉપરાંત મતદારકાર્ડ વિહોણા લોકોની યાદી આપી અને એવી વસાહતોના સરનામા આપ્યા જ્યાં રહેતા લોકો પાસે મતદાર કાર્ડ નથી. આ યાદીના આધારે ઘણું કામ થઇ શક્યું. હા નીચેના સ્તરે કેટલાક અધિકારીઓ સાથે થોડી તકલીફ પણ થઇ પણ પ્રયાસ ખૂબ સારો રહ્યો. આખા દેશમાં કદાચ આ પ્રકારે ગુજરાતમાં કામ થયું છે એવું ચોક્કસ કહી શકાય. આ ક્ષણે આદરણીય અનિતાબેન, તથા તમામ જીલ્લા કલેકટર અને આ કામમાં મદદરૂપ થયેલા તમામ અધિકારીઓનો અભાર માનીએ છીએ. સાથે સાથે vssmના કાર્યકરો જેઓને આ કામ માટે કરવા પડતા પ્રવાસ તથા અન્ય ખર્ચ માટે મદદ કરી તેવા vssm ના શુભેચ્છક , સ્વજનોનો પણ હ્રદય પૂર્વક આભાર માનું છું.
